NRE obligation in Public Installation
NRE obligation in Public Installation
Purpose
Buildings with gross area over 1,000 m2 that are newly built, added to existing buildings or reconstructed buildings are mandated to install new and renewable facilities generating over 10% of the total estimated energy consumption of the building. (The obligation rate is 12% since January 1, 2014)

The Article 12, clause 2 of the Act on the Promotion of the Deployment, Use and Diffusion of New and Renewable Energy and the article 15 of the Enforcement ordinance of the same Act

- Inception date of the obligation: March 29 2004

- The obligation has been applied to buildings that are added or reconstructed since March 15, 2009

- The criteria of obligation changed from construction cost to energy consumption on April 13, 2011

- Gross area threshold changed from 3,000 m2 to 1,000 m2 on January 1, 2012
-
- The obligation rate was raised to 12% on January 1 2015

Legal basis
- The article 12, clause 2 of the Act on the Promotion of the Deployment, Use and Diffusion of New and Renewable Energy and the article 15 of the Enforcement ordinance of the same Act
- The article 44 of the Regulation on the Support for New and Renewable Energy Facilities (MOITE Notification no. 2014-56)

- Local governments, public corporations, government invested institutions or corporations in which government- invested corporations invested more than minimum rates or amount decided by the Presidential decree
- Corporations in which government-invested corporations invested over 50/100 of paid-in capital
- Corporations in which government-invested corporations invested over 5 billion won of paid-in capital

- Corporations established by Special Acts
Buildings subject to the obligation

- Public buildings: correctional and military institutions (military institutions are excluded), broadcasting communication institutions, Office buildings

- Buildings with cultural, educational, social use: cultural and assembly facilities, religious facilities, medical facilities, educational facilities, facilities for children and old citizens, training facilities, sports facilities, cemetery facilities, tourism facilities, funeral halls

- Commercial buildings: Sales facilities, transportation facilities, accommodation facilities, amusement facilities
- Residential and other buildings (general storage, storage and process facility of hazardous material) are excluded
- School facilities were included on September 10, 2008
